What is Trade Agreements Act (TAA)?
The TAA of 1979 (19 U.S.C. §§ 2501–2581) is the law that allows the U.S. government to buy from trusted trading partners. For products sold under covered contracts and set one rule: the end products must be originated in the United States or from a TAA-designated country. It is about where a product is made, not where the box ships from.
What are “designated countries”?
These are countries the U.S. has trade agreements with, including: WTO Government Procurement Agreement countries (e.g., Germany, Japan); Free Trade Agreement partners (e.g., Canada, Mexico); some developing nations and Caribbean countries. Major countries like China, India, and Russia are NOT TAA-compliant sources.
Where is TAA compliance required?
TAA compliance is required by federal or government projects. It is non-negotiable and is a strict Yes or No gate for government contract eligibility. Primary advantage of TAA (Trade Agreements Act) compliant products is that they are legally eligible to be purchased by the US government and its agencies such as DoD (Department of Defense) and GSA (General Services Administration). This designation opens the door to many large public sector contracts while ensuring supply chain security and compliance with international fair-trade agreements.
Besides Trade Agreement Act (TAA), many times we also hear about Buy American Act (BAA) and the Build America, Buy America Act (BABA). What are the differences between these procurement laws?
The Difference:
These three Acts are often confused. They are different statutes with different scopes and remedies. They are all U.S. domestic procurement laws, but they apply in very different scenarios.
*Buy American Act (BAA): Applies to direct federal government purchases of supplies and construction materials for public use within the U.S. It requires the products to be manufactured in the U.S. and sets a minimum domestic content requirement of 65% (set to increase to 75% in 2029).
*Trade Agreements Act (TAA): Does not require a specific domestic content percentage; instead, it allows the government to buy goods manufactured or substantially transformed in the U.S. or from any of TAA-designated country including Japan, Canada, Mexico, the EU, South Korea and Australia.
*Build America, Buy America Act (BABA): This Act was passed as part of the 2021 Bipartisan Infrastructure Law. It applies to infrastructure projects funded by federal financial assistance (like grants given to state and local governments). It requires all iron, steel, manufactured products, and construction materials used in the project to be produced in the U.S.
